Legal framework governing the conditions for target fuel reserves is of paramount importance in all aspects of OLPP business activities. At present, Poland’s liquid fuel reserves are to cover a 90-day period. Simultaneously, compulsory fuel reserves made of diesel oil are to be lowered – to the level of 50 per cent from 2011. Poland must also secure fuel reserves against lack of access to reserves due to technical difficulties
(10 per cent). Moreover, the 3-day LPG reserves period in 2008 will be extended to
30 days in 2012. Act on biofuels that adapts the Polish low to UE requirements sets forth obligatory maintenance of 5.75 per cent biofuels share in the Polish transport fuel market in 2010.

The Policy of the Government of the Republic of Poland sets forth terms and conditions to create new system of obligatory reserves: general availability, which means that all entities manufacturing or importing vehicle fuels (including LPG & CNG) on the Polish market must equally share the burden of proper fuel reserves maintenance; elimination of discrimination, which means that obligations related to the maintenance of compulsory fuel reserves must not lead to any real discrimination of the fuel market participants (given the nature of their business activities – fuel manufacture / fuel trading – or the volume of turnover); finally, the third principle - abolishment of the obligation to physically maintain fuel reserves by companies against special-purpose fee charged for the maintenance of fuel reserves by public law entities.
